Welcome to maisonmirwad.com. These Terms & Conditions (“Terms”) apply to your access to and use of our website and services, and to the purchase of Products offered by Mirwad (“Company”, “we”, “us”, “our”), a business registered and operating under the laws of the State of Qatar. Please read these Terms carefully before using our website or placing an Order. By continuing to access or use the Site, you agree to comply with and be bound by these Terms. If you do not agree, you must refrain from accessing or using our Site


1. Definitions

For the purposes of these Terms:

  • Company: Refers to Mirwad, a Qatari company with its principal office registered in Qatar.

  • Website / Site: maisonmirwad.com, including all subdomains, digital platforms, and mobile versions.

  • Customer / you / your: The individual or entity accessing the Website, placing an Order, or purchasing Products.

  • Products: Any goods offered for sale, including but not limited to luxury perfumes, artisanal fragrances, bukhoor, oils, and branded accessories.

  • Order: A confirmed purchase request made via our online store hosted on Shopify.

  • Services: All services provided by Mirwad, including e-commerce functionality, payment processing, order handling, customer support, newsletters, and promotional campaigns.

  • Payment Methods: Payment services accepted on our Shopify store, including credit cards, debit cards, PayPal, Apple Pay, Shopify Payments, and other regional gateways.

  • Carrier / Delivery Partner: Third-party courier services (e.g. DHL, Aramex, FedEx) used to ship our Products.


2. Acceptance & Scope

  1. These Terms apply to all use of the Site, including browsing, creating an account, and placing Orders.

  2. By placing an Order, you confirm you are at least 18 years old or the legal age of majority in your jurisdiction, and you have the legal capacity to enter into binding contracts.

  3. All Orders are subject to our acceptance. You will receive a confirmation email acknowledging receipt of your Order. Only once this confirmation is issued is your Order considered binding.

  4. We reserve the right to modify, update, or amend these Terms at any time without prior notice. Any updated Terms will take effect immediately upon posting, and your continued use of the Site constitutes acceptance.


 

3. Account Registration & User Obligations

  1. You may browse the Site without creating an account, but certain features (such as faster checkout and order history tracking) may require account registration.

  2. You agree to provide accurate, complete, and up-to-date information during account registration and when placing Orders. Supplying false or misleading information may result in suspension or cancellation of your account.

  3. You are solely responsible for safeguarding your login credentials and agree to immediately notify us of unauthorized use of your account.

  4. You must not misuse the Site by introducing viruses, attempting unauthorized access, or engaging in activities that may damage or disrupt the Site’s functionality.


 

4. Orders & Payments

  1. To complete an Order, you must follow the Shopify checkout process and pay using one of the available Payment Methods.

  2. Prices are displayed in the currency of the country of your delivery address. Prices may include or exclude VAT and applicable taxes, which will be calculated at checkout. 

  3. We reserve the right to correct errors in pricing or product descriptions. If such an error occurs, we may cancel or amend your Order before dispatch.

  4. Full payment must be made at the time of purchase unless otherwise agreed. Orders will not be dispatched until payment is confirmed.

  5. All payments are processed securely through third-party providers. We do not store your credit card or payment details.


 

5. Delivery & Shipping

  1. We deliver domestically within Qatar and internationally through selected Carriers. Estimated delivery times are:

    • Qatar: 1–3 working days

    • GCC: 3–7 working days

    • International: 7–14 working days

  2. These timelines are estimates only and may vary due to customs checks, delays, or force majeure events.

  3. The risk of loss or damage passes to the Customer upon our delivery to the Carrier.

  4. International customers are responsible for import duties, customs taxes, and local regulations that may apply.


 

6. Returns, Refunds & Exchanges

  1. Due to hygiene and safety regulations surrounding fragrances, opened or used Products cannot be returned.

  2. Unopened Products in their original packaging may be returned within 14 days of receipt if you notify us at [support@maisonmirwad.com] and receive approval.

  3. If you receive a defective, damaged, or incorrect Product, you are entitled to a full refund or replacement at no extra cost.

  4. Refunds will be processed via your original payment method within 7–14 business days after inspection of returned goods.

  5. Customers are responsible for return shipping costs unless the return is due to our error.


 

7. Product Quality, Warranty & Liability

  1. We take pride in the quality and craftsmanship of our fragrances. All Products are carefully checked before dispatch.

  2. Individual reactions to perfumes (including allergies) may vary. We disclaim responsibility for adverse reactions unless caused by defects in the Product.

  3. To the fullest extent permitted by Qatari law, we exclude all implied warranties, including fitness for purpose and merchantability, unless otherwise required.

  4. Our liability is limited to the value of the Products purchased. We are not responsible for indirect, incidental, or consequential damages, including but not limited to loss of profits, reputation, or opportunity.


 

8. Intellectual Property Rights

  1. All content, designs, trademarks, packaging, product names, logos, text, graphics, photography, and audiovisual elements displayed on maisonmirwad.com are owned or licensed by Mirwad.

  2. Unauthorized reproduction, distribution, modification, or commercial use of our intellectual property is strictly prohibited.

  3. Customers may not resell Products, reproduce packaging, or use our trademarks without written authorization.


 

9. User Conduct & Prohibited Uses

You agree not to:

  • Use the Site for unlawful or fraudulent purposes.

  • Resell, duplicate, or distribute Products without our approval.

  • Upload malicious software or attempt to hack into our systems.

  • Interfere with security features, disrupt the website, or overload servers.

  • Harvest or scrape data using bots, crawlers, or automated tools.

Violation of these provisions may result in suspension, account termination, and potential legal action.


 

10. Force Majeure

We are not liable for failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, and extreme weather.

  • Strikes, labor shortages, or transport disruptions.

  • Political unrest, acts of terrorism, or governmental restrictions.

  • Failures of telecommunications, payment systems, or power supplies.


 

11. Governing Law & Dispute Resolution

  1. These Terms are governed by the laws of the State of Qatar.

  2. In the event of a dispute, both parties will attempt to resolve the matter amicably within 30 days of written notice.

  3. If no resolution is reached, disputes will be submitted to the competent courts of Qatar, without prejudice to mandatory consumer protection laws in your country of residence.


12. Modifications to Terms

  1. We reserve the right to revise or update these Terms at any time.

  2. The “Last updated” date at the top indicates the most recent revision.

  3. Continued use of the Site after modifications indicates acceptance of the updated Terms.


 

13. Severability & Waiver

  1. If any part of these Terms is found to be invalid or unenforceable, the remaining sections will remain in effect.

  2. Failure to enforce any provision does not constitute a waiver of that provision or any other rights under these Terms.


 

14. Privacy & Data Protection

  1. We respect your privacy and are committed to protecting your personal information.

  2. Data collected during your use of the Site or purchase of Products is used for:

    • Processing and fulfilling your Orders

    • Providing customer service

    • Marketing communications (if you opt in)

    • Website optimization and fraud prevention
